This was very hard work, cos I studied very carefully military- and social structures of Rome. And of course, as usual, laws from codex Theodosianus. I was amazed at how different my view begins to be compared to common views of this history. The catholic church history and barbarian migration have a surprising new and massive part of Roman decline and fall. And I knew that is not what Finnish authors want to here.

My aim in this essay is to elucidate the meaning of the phrase collegia sodalicia, which occurs only in Digests 47.22.1 pr. (= Marcian F 73a Lenel), the introductory section of the Digests’ title De collegiis et corporibus (47.22).

In the first part of this essay, I outline some salient features of Marcian F 73a and briefly contextualize Marcian’s Institutes, the work of late Severan date from which Justinian’s compilers excerpted Digests 47.22.1 pr.-1.2.

In the second part, I demonstrate that the purported “sodalician associations” of Digests 47.22.1 pr. never existed. That phrase originated from a textual misunderstanding, which one can trace already in the Digests, if not before. I propose that Marcian wrote collegia sodaliciaue, “collegia or sodalicia”. I then segue to some of the implications my reinterpretation of Marcian F 73a holds for the study of associations in the Roman world.

After they talked about procuring peace with lengthy speeches, Amphimachus stood up, a young son of Priam, very brave, delivered a horrid speech against Antenor and those who had consented. He upbraided their deeds, argued instead to muster the army and invade the camp until victorious or fall for the fatherland defeated. After he concluded, Aeneas stood up, contested Amphimachus with calm and gentle words, argued to seek peace from the Argives with urgency. Polydamas persuaded the same.

Ghignoli argues convincingly that it resalts, in fact, from a mistranscription by the baffled tweltfth-century notary responsible for the copy in wich the document survives of the contextually much more fitting word 'massari'.

Una recente ordinanza della Corte di cassazione esamina le condizioni di applicabilità della TOSAP alle aree oggetto di dicatio ad patriam. Prendendo avvio da tale pronuncia, il saggio propone un’indagine dell’istituto, volta a evidenziarne le caratteristiche peculiari e a metterne in luce le radici romane. Delineati i tratti della figura nel diritto vigente, vengono dunque analizzati i pertinenti testi del Digesto, e in particolare Ulp. 9 ad ed. D. 41.1.41, Ulp. 71 ad ed. D. 43.24.11.1 e Lab. 6 pith. a Paul. epit. D. 44.1.23, donde emerge come la mens del positor e la volontà di arricchire la collettività costituiscano elementi qualificanti della fattispecie nella riflessione dei giuristi romani. Di conseguenza, se ne auspica conclusivamente una valorizzazione anche in sede giurisprudenziale, in ragione del sicuro nesso genetico esistente tra l’istituto odierno e le fonti antiche.

A recent ruling of the Court of cassation examines the conditions for the applicability of TOSAP to areas subject to dicatio ad patriam. Moving from this decision, the essay proposes a survey of the institute aimed at highlighting its peculiar characteristics and its Roman roots. After outlining the features of the figure in current law, the relevant texts of the Digest are analysed, with special reference to Ulp. 9 ad ed. D. 41.1.41, Ulp. 71 ad ed. D. 43.24.11.1 and Lab. 6 pith. a Paul. epit. D. 44.1.23. As a result, the article shows how the mens of the positor and the will to enrich the community qualify the dicatio in the thinking of the Roman jurists. Consequently, it suggests that they be accepted as essential elements by the courts, in line with the sure genetic link between today’s institution and the ancient sources.

The Roman empire set law at the center of its very identity. A complex and robust ideology of law and justice is evident not only in the dynamics of imperial administration, but a host of cultural arenas. Citizenship named the privilege of falling under Roman jurisdiction, legal expertise was cultural capital. A faith in the emperor’s intimate concern for justice was a key component of the voluntary connection binding Romans and provincials to the state.
Even as law was a central mechanism for control and the administration of state violence, it also exerted a magnetic effect on the peoples under its control. Adopting a range of approaches, the essays explore the impact of Roman law, both in the tribunal and in the culture. Unique to this anthology is attention to legal professionals and cultural intermediaries operating at the empire’s periphery. The studies here allow one to see how law operated among a range of populations and provincials—from Gauls and Brittons to Egyptians and Jews—exploring the ways local peoples creatively navigated, and constructed, their legal realities between Roman and local mores. They draw our attention to the space between laws and legal ideas, between ethnic, especially Jewish, life and law and the structures of Roman might; cases in which shared concepts result in diverse ends; the pageantry of the legal tribunal, the imperatives and corruptions of power differentials; and the importance of reading the gaps between depiction of law and its actual workings.
This volume is unusual in bringing Jewish, and especially rabbinic, sources and perspectives together with Roman, Greek or Christian ones. This is the result of its being part of the research program “Judaism and Rome” (ERC Grant Agreement no. 614 424), dedicated to the study of the impact of the Roman empire upon ancient Judaism.

The article describes the double documents from the Judaean Desert, on the one hand their material conditions and their lay out, on the other hand the relationship between the upper (inner) and the lower (outer) texts. There are three different forms: two widely identical texts, written one below the other on one side of a sheet; two such texts the first of which starts on the back of the sheet; and, third, documents with a noticeably shortened upper text. The upper text is often less carefully written. Both the lay out and some of the differences between the two texts point to the conclusion that the upper text was written first, while the lower text was copied from the upper one.

The impact of the so-called ‘Crisis of the Third Century’ on Roman rule and legal practice is often thought to have been due to a new type of Roman emperor. This is borne out by the frequent use of such terms as 'soldier emperors' (or 'barracks emperors'), ‘anarchie militaire’, or ‘Zeit der Soldatenkaiser’ to describe the period from 235 to 283 CE. The new type of emperor is said to have had a particularly good relationship with the soldiery to which alone he allegedly owed his power. A close analysis of the most significant, mainly documentary sources suggests otherwise. The sources examined in this contribution appear to indicate that the so-called 'soldier emperors' remained deeply rooted in imperial traditions. Their rule was not the rule of the military. The soldiers much rather experienced decades of particular hardship and danger without receiving any additional significant and permanent bonuses in return.

En 1241, Camarès s'appelle encore « le Pont »et son seigneur Guilhem Du Pont est puissant dans ce coin-ci du Rouergue. Il est issu d'une importante baronnie remontant à la période carolingienne qui possède encore la plupart des terres du Rougier, même si ses aïeux ont largement contribués, par l'intermédiaire d'Arnaud Du Pont et ses nombreuses donations, à l'installation de l'abbaye de Sylvanès vers 1136. Mais ils eurent aussi des largesses avec l'Ordre de l'Hôpital qui était installé depuis 1121, à Prugnes. La charte de 1241 dont il est question dans cette étude parle d'un règlement entre le seigneur Guilhem du Pont et Berenger de Campagnoles, précepteur de l'Ordre de Saint-Jean de Jérusalem, au sujet du devès de Prugnes et de celui de Ginebret, deux terroirs situés dans le Nord-Est de Camarès. Cette charte est déposée aux Archives Départementales de Haute-Garonne, dans le très riche Fonds de Malte et sa photocopie m'a été transmise par l'intermédiaire de Claude SENEGAS que je remercie ici. Nous allons en tenter la transcription ainsi qu'une ébauche de traduction, puis nous proposerons un commentaire, précédé d'un essai d'identification des lieux et des personnes cités.

This is an interdisciplinary, edited collection on social science methodologies for approaching Roman legal sources. Roman law as a field of study is rapidly evolving to reflect new perspectives and approaches in research. Scholars who work on the subject are increasingly being asked to conduct research in an interdisciplinary manner whereby Roman law is not merely seen as a set of abstract concepts devoid of any background, but as a body of law which operated in a specific social, economic and cultural context. This context-based approach to the study of Roman law is an exciting new field which legal historians must address. Since the mid-1960s, a new academic movement has advocated a law and society approach to the study of Roman law instead of the prevailing dogmatic methodology employed in many Faculties of law. This book aims to further the current debate on the interface between legal history and ancient history. It brings together a distinguished group of scholars who will provide different perspectives on this debate. It addresses particular themes within this debate such as law and legal practice, law and gender as well as law and economics.

The debate on the meaning of pistis in 2 Peter 1:1 has alternated between subjective faith (belief) and objective faith (the Faith). However, agreeing with Fredrick W. Danker’s analysis, a secular Hellenistic meaning of pistis better explains the distinctive context of 2 Peter 1:1 and 2 Peter’s use of pistis. Applying ten patterns for the use of pistis as a pledge of safe-conduct, gleaned from its use in secular Hellenistic literature contemporary to 2 Peter, we conclude that 2 Peter 1:1 uses pistis as a pledge of safe-conduct, which introduces 2 Peter’s theme and its controlling journey metaphor.
